Personal Release: In full and complete consideration of allowing me without any further consideration due from Holiday Club Management Company de Mexico, S.A. de C.V., and/or Holiday Club Management Company Ltd. (herein after “Holiday Club”) and/or any of its affiliates or any third party to me, and with the understanding that Holiday Club, in its sole discretion may choose whether or not to include my photograph(s) in any Royal Holiday Communications material like website, Newletter, e-news, POP, sales offices and direct mail material, I hereby agree as follows.
I grant to Holiday Club, its successors, licensees and assigns, the irrevocable right, but not the obligation, with or without my knowledge, to use my photograph(s) to publish and / or distribute in Royal Holiday Communication Materials in any manner and in its discretion. I agree that Holiday Club is the sole owner of the photograph(s) I submit and my appearance thereon, with the rights to display or utilize, without limitation, with advertising, sale, promotion, marketing, merchandising distribution, publicizing and all other types of advertising and Holiday Club shall be the sole owner of all results and proceeds of such use. I hereby assign to Producer any rights necessary to give effect to the foregoing. The foregoing shall not entitle me to receive any compensation whatsoever. I represent and warrant that (i) I am not a party to any contract for management and/or talent agent representation or any other arrangement which prevents me, or might prevent me, from entering into any agreement for the use of my appearance. I agree not to make any claim against Holiday Club in connection with any use or reuse of my Appearance in my photograph(s) including, without limitation, any claim based upon defamation or invasion of privacy and/or publicity. I warrant that I am at least 18 years of age and that I have the full, complete and unrestricted right and authority to enter into this Release. I agree and understand that this Release shall be deemed entered into Mexico Jurisdiction, and that it shall be governed by and interpreted under the laws and courts of Mexico.
